When you are arrested for DUI in West Virginia, the Department of Motor Vehicles is notified. The DMV has the authority to suspend your license even if your case has not yet been decided in court. This is called an administrative suspension and it can happen quickly.
The length of the suspension depends on whether this is your first DUI or if you have prior convictions. For many first time offenders, the suspension can last from several months up to a year. If you refused to take a breath or blood test after your arrest, the suspension period is often longer. Repeat offenses lead to even harsher penalties, sometimes including permanent revocation of your license.
