Understanding the Difference: Non-Aggravated DUIs and Aggravated DUIs
In West Virginia, there are two types of DUI offenses. You can be charged with an aggravated DUI if your BAC is greater than .15%. Aggravated DUIs carry stiffer penalties than non-aggravated first-time DUI offenses. For example, if you were convicted of a non-aggravated DUI, it is unlikely you would face any jail time. For an aggravated, offense, however, you could spend up to 6 months in jail for a first-time offense.
