Understanding the Difference: Non-Aggravated DUIs and Aggravated DUIs

In West Virginia, your BAC has a significant impact on your case. You can be charged with an aggravated DUI if your BAC is greater than .15%. If your BAC is below .15%, the DUI will be considered non-aggravated. Aggravated DUIs carry stiffer penalties than non-aggravated first-time DUI offenses. Regardless of if the charge is aggravated or non-aggravated, you could spend up to 6 months in jail for a first-time offense.

Other penalties for a non-aggravated first-time DUI conviction include:

  • A fine between $100 and $500
  • License revocation for six months or 140 days of an ignition interlock device in the driver’s vehicle.

For a first offense with refusal of the breath machine, drivers can face up to six months in jail, a fine of $100 to $500, and either driver’s license suspension for one year or thirteen and one-half months interlock installation in vehicle.

What Happens if I Have More Than One DUI Conviction?

If you have prior DUI convictions on your record, the penalties will become increasingly severe.

For three or more DUI convictions, you can face some of the following penalties:

  • A jail sentence between two and five
  • A fine between $3,000 and $5,000
  • Lifetime license revocation or four years of a mandatory ignition interlock device in your vehicle
