What happens if I violate the terms of DUI deferral?

Answer:

One of the issues that I get presented at the Wagner Law Firm, West Virginia’s only exclusive driving under the influence defense firm, is citizens that will already be into the deferral program, our first offender program, and they get bounced out or kicked out, and they want to continue on.

Once you enter into the West Virginia deferral program, they’ve got you.

You’ve entered a conditional plea of guilty, and if you don’t do A, B, C, and every single protocol for dismissal, then you come back before the court, and it’s very simple. It moves from a deferred adjudication, which is a fancy term for just putting it on a shelf, to a permanent lifetime conviction, and there’s nothing you can do about it because you already conditionally pled guilty, and nobody clearly explained it all to you.
