What happens at the first court date for a DUI in West Virginia?

Answer:

The overwhelming majority of my clients at the Wagner Law Firm in 27 years have never been in the criminal justice system a day in their life. Good people from all walks got themselves in a little predicament and need some quality help by someone that knows what they’re doing, and years of experience and training in the field of DUI defense.

I try to often sit down with them right away and provide the roadmap ahead. One of those issues in the roadmap ahead is the very first hearing.

At the very first hearing, I tell them, “Look, the very first hearing’s much more informal. It’s going to be a couple months from now at minimum.

You’re going to get your hearing notice in the mail, oftentimes two to three weeks post the arrest, but the date itself isn’t going to be till probably two and a half to three months down the road. The very first hearing is much more informal.

It’s what you do between now and that first hearing that matters the most. Getting everything out and filed timely, all your interests protected, getting to know you and your case thoroughly.”

When that first hearing rolls around, and the prosecutor wants to sit down and talk to me about the case, any potential resolution, agreement, it’s a much more informal proceeding like that. We’re thoroughly ready and prepared to go, and all your rights have been put in place.

Which is why it’s important that you reach out to an experienced DUI attorney immediately, so that all of your rights can be protected long before that initial hearing. Yes, you have to be with me at it, but far more often than not, you don’t even walk in the courtroom with me.
