Understanding West Virginia’s DUI Laws and Penalties

Driving in an impaired state means having a blood alcohol content level higher than the legal limit. For noncommercial drivers, that limit is .08 percent; for commercial drivers, it is .04 percent; and for underage drivers, it is .02 percent. It also includes the influence of drugs, or a combination of both.

The penalties of impaired driving depend on a variety of factors, such as whether this is a first-time offense, or if there are minors in the vehicle at the time of the arrest. Depending on the circumstances of the case, a driver convicted of a first-time DUI may face:

  • A jail sentence of up to six months
  • A fine of up to $1,000
  • A suspension of your driver’s license for up to one year or thirteen and one-half months of ignition interlock in your vehicle

A second-time DUI, however, will result in:

  • A jail sentence of up to a year
  • A fine of up to $3,000
  • A suspension of your driver’s license for ten years or three years of interlock installation in your vehicle

Finally, penalties for a third-time DUI include:

  • A jail sentence of up to five years
  • A fine of up to $5,000
  • Driver’s license revocation for life or four years of interlock installation in your vehicle.

All drivers convicted of a DUI must also complete the DUI Safety and Treatment Program before their driver’s license can be reinstated.
