What are the Penalties for DUI Causing Death in West Virginia?

Drunk or drugged driving that causes death in West Virginia is an aggravated DUI, which can be charged as either a misdemeanor or a felony. A misdemeanor conviction carries:

  • a jail term ranging from 90 days to more than one year,
  • a fine between $500 and $1,000,
  • and driver’s license revocation for five years.

However, if the intoxicated driver operated a vehicle with a reckless disregard for the safety of others and such recklessness caused a crash that led to another person’s death, then DUI causing death will be charged as a felony, punishable by:

  • imprisonment between three and 15 years,
  • a fine ranging from $1,000 to $3,000,
